A federal judge says enforcing the requirement that Pennsylvania mail-in ballots include an accurate exterior envelope date violates the federal Constitution.

Judge Susan Paradise Baxter found the law serves no compelling government interest and doesn’t justify infringing on voters’ First Amendment rights.

A federal judge ruled Monday that Pennsylvania counties cannot reject mail ballots simply because a voter failed to date or put a wrong date on the ballot’s outer envelope. Judge Susan Baxter of Pennsylvania’s Western District found that the state’s dating requirement for mail ballots violated voters’ First and Fourteenth Amendment rights and therefore could not be enforced.
